Performance Centre Public Use
Terms & Conditions – Updated October 2022

1. The Proprietor
(a) The Proprietor shall mean CGLMC Ltd (the organisation) and shall include the manager and any employee or agent of the Proprietor.

2. Physical condition of the User
The user warrants and represents that he/she is in good physical condition, furthermore, he/she warrants that he/she can engage in active or passive exercise and that such exercise would not be detrimental to his/her health, safety, comfort and or physical condition.

3. Usage and booking
(a) Users will have access to book online via the website up to 14 days in advance.
(b) Payment will be taken at the time of booking.
(c) Cost of sessions will available via The Performance Centre website and will be displayed at time of booking.
(d) A maximum of 4 users will be permitted in any one bay per session.
(e) Duration of sessions may be 60 minutes or 120 minutes.

4. Cancellation Policy, Rescheduling Sessions and Refund Policy
(a) A User may reschedule a session free of charge at any time before their session begins.
(b) A User may cancel a session free of charge at any time before their session begins.
(c) If a User cancels a booking, the refund will not be carried out automatically. The refund will be processed manually by staff on a weekly basis, therefore, Users may have to wait 7-10 working days for a refund to be processed to the card used during the online payment process.
(d) If a session is not cancelled more than 12 hours in advance, the User is not entitled to a refund.
(e) If a session is not rescheduled in advance, the User is not entitled to a refund.

5. Online Payment and Information Provided
In relation to users paying online and to whom the Distance Selling Regulations apply, Users also confirm and warrant that the information that they have provided as part of the application is true and accurate in all respects.

6. User Conduct
A User must:
(a) comply with any applicable dress code for the building:
(b) show consideration for other Users, Members and their Guests and staff in and around the premises:
(c) not use abusive or bad language:
(d) not bring, use or be under the influence of illegal drugs in any part of the premises:
(e) not be drunk in or about the premises:
(f) not behave in an anti-social or disruptive manner, including but not limited to inappropriate or threatening behaviour, misuse of equipment or sexual activities.
(g) be respectful of the equipment within the facility.

7. Rules pertaining to young persons (under 16)
(a) Persons under the age of 16 cannot enter or be left at the Performance Centre unattended unless attending an organised activity such as those run by the Golf Development Team.
(b) Persons under the age of 16 must be supervised by an adult at all times.
(c) Parents/Guardians are responsible for their children(s) behaviour at all times during a visit to the Performance Centre. A User’s child should also be expected to adhere to the User Conduct Rules (see paragraph 6 above). Misconduct by the User’s child will be regarded as the User’s own misconduct.
(d) Persons under the age of 16 are permitted to use the facility free of charge, if accompanied by an adult (someone who is 16 years or older). An Adult user can add an Under-16 user via the online booking platform prior to arriving at the facility. The Under-16 user will share the bay with the adult during the session.

8. Queries
For any query that cannot be satisfactorily dealt with by the department staff concerned, please ask for a supervisor or send an email to [email protected].

9. Hours of Opening and Specific Closure Dates
(a) The Performance Centre’s hours of operation can be obtained through visiting our Performance Centre page on the Carnoustie Golf Links website.
(b) The Performance Centre will be closed on Christmas Day and New Year’s Day. The facility will also close at specific times throughout the year when access to Links House is restricted for major golf events that Carnoustie Golf Links is hosting (eg. The Alfred Dunhill Links Championship or The Open Championship). These dates will also be displayed on Carnoustie Golf Links website.
