Gift Card Terms and Conditions

IMPORTANT – PLEASE READ: These terms and conditions set out the basis on which you can use a Carnoustie Golf Links Gift Card and apply to Carnoustie Golf Links Professional Shop and The Rookery gift cards. Purchase and use of the card will constitute acceptance of these Terms and Conditions. You must therefore read them carefully. If there is anything you do not understand, please contact our team at Carnoustie Golf Links.

1. Definitions

Within these Terms and Conditions, the following definitions shall apply:

Card User” or “you” means the owner, giftee or authorised person benefiting from the use of the gift card;

Team” means the team at Carnoustie Golf Links who can be contacted via email at [email protected] or via phone on 01241 802296;

Gift card” means the Carnoustie Golf Links Gift Card purchased by you or given to you, which may be credited with a value determined by the Card User at time of purchase and available within Carnoustie Golf Links Pro Shop and The Rookery;

Carnoustie Golf Links”, “we” or “us” means Carnoustie Golf Links Ltd, The Professional Shop and The Rookery.;

Carnoustie Golf Links Privacy Policy” means the privacy policy of Carnoustie Golf Links, available at https://www.carnoustiegolflinks.com/privacy-policy/; and

Terms and Conditions” means these terms and conditions, as amended from time to time.

2. Obtaining your card

Gift cards are issued by, and remain the property of, Carnoustie Golf Links. We do not authorise anyone else to sell or distribute the card. Gift cards can only be obtained from Carnoustie Golf Links.

3. Gift card

The gift cards are electronic money products. When you credit value to your gift card, you will be purchasing electronic money from Carnoustie Golf Links.

You can use your gift card at Carnoustie Golf Links Professional Shop and The Rookery. It is not a credit card, charge card or debit card. Upon purchase of a gift card, a minimum credit of £10.00 is required. Cards are not re-loadable and once purchased cannot top up the balance or be part refunded. Gift cards cannot be used on any online store.

The gift card is valid for a period of 18 months from the date of purchase. After this period, your card will cease to be valid, and any remaining credit value stored on the card will expire. Expired value cannot be transferred to a new card or redeemed. The gift card will not be able to be redeemed once it has ceased to be valid

4. Ownership and use of your card

Your gift card is intended for your personal use and, as such, you are not entitled to sell, distribute, or otherwise make any commercial use of your card (including in relation to any promotional commercial activity).

For clarity, this shall not prevent you from giving a gift card as a gift, provided that such gifting is not part of or connected to any commercial activity (including any promotional commercial activity).

Gift cards can only be used for purchases within Carnoustie Golf Links Professional Shop and The Rookery. Gift card identification must be presented at a point of sale and cannot be spent online. Gift cards cannot be used in the Professional Shop for lessons or performance centre.

The amount redeemed from the gift card and the balance remaining on it will be shown on the till receipt, which should be kept. To check the balance on a gift card or any queries please contact 01241 802296 .

Gift cards should be treated like cash, please ensure that it is kept safe until needed. Carnoustie Golf Links cannot be held liable for lost or stolen gift cards or any amounts on such cards, and we cannot offer cash or credit in place of the balance on a lost or stolen gift card.

If the entire value of the card is not redeemed in a transaction, the balance will remain on the gift card until it is used again or until it expires.

Change will not be given on a gift card, nor will we exchange the balance for cash.

5. Returns

If you wish to return an item which has been purchased at the Carnoustie Golf Links Professional Shop you must do so within the time limits specified by the returns policy within the Carnoustie Golf Links Professional Shop.

The value of the return can be swapped for another item of the same value. Alternatively, Carnoustie Golf Links may, at its option, issue you with a new card credited with the value of the returned item(s).

6. Cancellation

You have the right to cancel your gift card at any time up to 7 calendar days after the day on which the gift card is purchased, provided none of the balance has been spent.

7. Loss, Theft or Damage

7.1 If you lose your gift card or if it is stolen, you may lose any value which is stored on it.

7.2 You should immediately report any loss, theft, fraudulent or unauthorised use of your gift card to our team.

7.3 In the event of loss, theft, fraud, or other unauthorised use of your gift card or if your card is damaged or malfunctions, we may, at our sole discretion, replace your card and transfer any credit value stored on it at the time of reporting the incident.

7.4  There are circumstances under which we may determine (at our sole discretion) that we will not replace your card. Such circumstances include, but are not limited to, instances where we reasonably believe that the notified incident has been caused by your wilful breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are, or have been, engaged in fraudulent or other unlawful conduct.

7.5 If you subsequently find or retrieve a card which you have reported lost or stolen, you must notify our Team immediately.

8. Variation and Assignation

We reserve the right to amend or waive any provision of these Terms and Conditions from time to time and at any time, or to terminate the operation of gift cards on reasonable notice. The Terms and Conditions applicable to the use of your card shall be the terms and conditions published on the website (https://www.carnoustiegolflinks.com/gift-card-terms) at the relevant time and your continued use of your gift card shall constitute your acceptance of such Terms and Conditions.

9. Entire Agreement and Construction

These Terms and Conditions constitute the entire agreement between you and Carnoustie Golf Links and supersede all prior proposals and all other agreements in respect of the subject matter of these Terms and Conditions and are subject to change without notice. If any provision of these Terms and Conditions is illegal or unenforceable, that provision will be deleted from these Terms and Conditions, and the remaining terms will not be affected. CGLMC Ltd, Carnoustie Golf Links Ltd reserve the right to change these terms and conditions at any time for operational reasons, or to prevent fraud.

10. Governing Law

These Terms and Conditions are governed by Scottish law.
